THE Marikina Regional Trial Court has ordered Television and Production Exponents Inc. (TAPE) and GMA-7 to stop using the trademarks \u201cEB,\u201d \u201cEat Bulaga\u201d and the Eat Bulaga jingle in its shows.<\/p>\n

Marikina RTC Branch 273 has granted the petition of Tito Vic and Joy (TVJ) on its copyright case.<\/p>\n
<\/p>\n
<\/p>\n
TVJ has filed a copyright infringement and unfair competition complaint against TAPE and GMA-7.<\/p>\n
<\/p>\n
<\/p>\n
In a decision dated Dec. 22, 2023, which was received by TVJ\u2019s lawyers from DivinaLaw on Jan. 5, the Marikina court granted TVJ\u2019s complaint against TAPE.<\/p>\n
<\/p>\n
<\/p>\n
\u201cAs such, the court prohibited TAPE and GMA from using the trademarks \u2018EB\u2019 and \u2018Eat Bulaga\u2019, the Eat Bulaga jingle, from its shows,\u201d the ruling stated.<\/p>\n
<\/p>\n
<\/p>\n
Following the decision, TVJ is now allowed to use the trademarks and jingles in its shows.<\/p>\n

\u201cIn view of defendant TAPE\u2019s failure to make a categorical and specific denial of the claim of Joey that he coined, formulated and worded the title Eat Bulaga, including the specific explanation how such a portmanteau was created, given the millions of words in the dictionary, the court, therefore, rules that plaintiffs have successfully proved and established, by preponderance of evidence, that Joey and his co-plaintiffs Tito and Vic should be credited with the formulation and creation of the mark Eat Bulaga,\u201d the court ruling said.<\/p>\n
